Objectives
BASIC SKILLS CB6 Possess and acquire knowledge that provides a basis or opportunity to be original in the development and/or application of ideas, often in a research context. CB7 Make the students able to apply the knowledge acquired, and their ability to solve problems in environments that are new or little known within broader contexts (or multidisciplinary) related to their field of study. CB8 Make the students able to integrate knowledge and face the complexity of exercising judgment from information that, being incomplete or limited, includes reflections over the social and ethical responsibilities linked to the application of their knowledge and judgments. CB9 Make the students capable to communicate their conclusions and the knowledge and ultimate reasons that support those conclusions, to a public that may be specialized or non-specialized in a clear and unambiguous manner. CB10 Make the students possess the learning skills that allow them to continue studying in a way that will, to a great extent, have to be self-directed and autonomous. GENERAL SKILLS CG1 Understanding the importance of civil liability as a sector of law with its own entity CG2 Learn to identify civil liability relationships and learn about their legal treatment CG3 Perceive the unitary character of civil liability and the necessary multidisciplinary view of the legal problems it poses CG4 Knowing the legal regime of civil responsibility from different perspectives of the Law, not only national, also from the international discipline CG5 Learning to identify the legal problem and give a solution to it CG6 Issue critical judgments on legal issues related to civil liability. CG7 Apply legal analysis methods that allow the student to be able to study and synthesize the information received. SPECIFIC COMPETENCES CE1, CE5, CE10, EC11 CE1 Understand the treatment of civil liability from the standpoint of private law CE5 Identify the competent bodies, the applicable legislation and the possible recognition or enforcement of the resolutions issued in cases of international civil liability CE10 Analyze the different treatments of civil liability, its problems and its solutions. CE11 Understand the assumptions of civil liability from a global perspective, as a whole, with legal problems arising from the different branches of law. LEARNING OUTCOMES: The overcoming of the subject supposes for the students to know to solve real cases relative to claims of responsibility in international relationships. In the subject the professor will explain the methodology to study and analyze a practical case of civil liability and the way of solving it. Therefore, the student must be able to identify the relevant facts of the case, in order to be able to determine the competent court before which to claim, and must know in advance the law that this judicial body will apply to resolve the case. Also, the student will know the mechanisms of action that provide by the legislation to respond to the behavior of the other party in the litigation.
