Objectives
COMPETENCES - To have and understand knowledge that provides a basis or opportunity to be original in the development and / or application of ideas, often in a research context. - Students will be able to apply the acquired knowledge and problem-solving skills in new or unfamiliar environments within broader (or multidisciplinary) contexts related to their area of ¿¿study. - That students be able to integrate knowledge and face the complexity of making judgments from information that, incomplete or limited, include reflections on social and ethical responsibilities linked to the application of their knowledge and judgments. - That the students know how to communicate their conclusions and the latest knowledge and reasons that support them to specialized and non-specialized audiences in a clear and unambiguous way. - That students have the learning skills that allow them to continue studying in a way that will be largely self-directed or autonomous. - Understand the entire institutional framework of intellectual property and master the access and management of its sources of legal information -To acquire a systematic knowledge of all the legislation applicable to the subject of the Master, as well as the jurisprudence of the Supreme Court and the Court of the European Union, being able to analyze, interpret and apply it -To be able to identify conflicts of interest that occur in the field of intellectual property and determine the techniques for their resolution -To elaborate legal texts of quality in which the student is able to synthesize the acquired knowledge and to reason unpublished proposals or to innovate solutions before the changing social reality in the field of the intellectual property -To integrate the peculiarities of intellectual property in the general system of acquisition, modification, transmission and extinction of the real rights - To have a solid background on the fundamentals and principles of intellectual property that allow the development of knowledge and techniques acquired in an autonomous, personal and direct manner -To subsume in the pertinent legal provision any factual situation related to the reality contemplated by the intellectual property legislation and obtain the corresponding legal consequence  -To elaborate and synthesize in a clear and precise contractual text the rights and obligations of the parties in the assignment of rights of exploitation on the works and protected services, specifying the exploitation modalities included in each of the rights and respecting the mandatory law whether or not it is expressly formulated -To advise persons, institutions and companies that use products or services protected by intellectual property in relation to legally relevant facts, including analysis of legal problems, risk assessment or possible responsibilities and professional decision-making -Provide the exercise of professional activities in the field of intellectual property, both in advisory and transactional work, as well as contentious or litigious situations through the exercise of pretensions or civil, commercial, criminal and administrative actions -To determine the legal and regulatory requirements that require the development of a business project of commercialization of material protected by intellectual property through services of the information society - To determine the applicable legislation and the competent jurisdiction in the transnational litigation -To know how to manage intellectual property rights in the different markets related to creations, products and services protected by intellectual property -Evaluate the potential for defrauding the holders of intellectual property rights in the digital environment.
Description of contents: programme
The Master¿s Thesis consists of the elaboration of a written paper about any of the subjects studied in the Master and its public defence before a tribunal. It has to have preferably a practical or professional perspective, although it may also consist of a research paper with the aim of a practical implementation. In particular, the Master¿s Thesis shall cover some of the following activities (without prejudice of others): - The preparation of an expert report about a complex matter that affects a great part or, insofar as possible, all of the different subjects. - The development of a business project related to the works or performances protected by Intellectual Property in the specific market. - The complete development of the creation, production and commercialization process (through the different existing channels) of any of the protected works, in particular musical works, audiovisual, electronic data bases and software. - The preparation of a paper, starting with the doctrine and case law available, which analyzes in a critical manner the different alternatives that may exist to solve a problem or a conflict of interests. The Master¿s Thesis shall be prepared individually, although, depending on the nature, volume and complexity of the subject, it may be given to two or three students as a group. Once finished, the Master¿s Thesis has to be defended before a tribunal composed of three teachers from the Master.
