Objectives
This course is the result of an agreement between Carlos III University and "Colegio Nacional de Registradores de la Propiedad y Mercantiles de España". It is tought by a "Registrador" (the person who rules the Property Registry) with wide practical experience. The goal of this subject is providing the students wiht knowledges about the functions and practical running of the Property Registry in order to qualify them for legal advice in the field of inmovable goods transactions.
Learning Outcomes
K3: Master the fundamental concepts and principles of the different sectors of the legal system. K7: To know the legal tools and instruments applicable to the interpretation and integration of the legal system, as well as to the resolution of conflicts, in the field of Private Law. K10: To know the institutional organisation of the State and the international and community organisations of which it is a part. K12: Understand the ethical dimension of law and the need to act responsibly in the defence of fundamental rights and social justice. S1: Plan and organize teamwork by making the right decisions based on available information and gathering data in digital environments. S2: Use the information by interpreting relevant data avoiding plagiarism, and in accordance with the academic and professional conventions of the area of study, being able to evaluate the reliability and quality of such information. S3: Apply the necessary skills to search for information in the different legal sources (legal, jurisprudential and doctrinal). S4: Apply organizational skills and critical management of legal knowledge. S5: Correctly diagnose legal problems and apply the appropriate tools for their solution. S6: Identify and appropriately use tools for the resolution of conflicts between individuals. S9: Correctly and effectively use oratory and legal argumentation. S10: Write and structure legal documents correctly. S11: To develop with autonomy and respect for deontological principles in their work and professional performance. C1: Know how to analyse, elaborate and defend individually a problem in the disciplinary field of the Bachelor's Degree by applying the knowledge, skills, tools and strategies acquired or developed in it. C2: Know and be able to manage interpersonal skills on initiative, responsibility, conflict resolution, negotiation, etc., that are required in the professional field. C3: Select and interpret legal and conventional regulations, jurisprudence and judicial doctrine applicable to different legal systems. C4: Be able to solve complex legal problems by applying creativity and innovative ideas. C5: Transmit legal information in a clear, precise and understandable way, both orally and in writing, adapting to various professional contexts.
Description of contents: programme
This course extends the study of "Property Registry Law", which is very brief in the course of civil Law related to Property ant Real rights. The study of this subject is made from a practical perspective as it is tought by a "Registrador de la Propiedad". Contents are basically: Real rights and publicity. The Property Registry. The goal of publicity. The "inmatriculacion" of estate (first registration of the property). Registry Procedure and Organization. Kinds of entries in the Property Registry. The effects of the registration. The "Publich faith" principle. Provisional notations. The Registry and the reality.
Learning activities and methodology
The teaching methodology entails explanations about the main aspects of the matter and learning based on case study. The students will be provided with practical cases which they will have to solve. They will also have to discuss and legally argue about them.
