Legal theory of crime
Objectives
This subject has the objectives of the acquisition by the student, the following powers: 1- Knowledge of criminal protection of human life independent and dependent or prenatal, health and bodily integrity. 2- Knowledge of criminal protection of freedom, moral integrity and sexual freedom. 3- Knowledge of criminal protection of privacy, the right to self-image, the inviolability of the home and honor. 4- Knowledge of the criminal protection of the rights of workers and foreign citizens. 5- Knowledge of the criminal protection of land planning, heritage and the environment. 6- Knowledge of the criminal protection of collective security. 7- knowledge of the crimes of falsehoods. 8- Knowledge of the criminal protection of the Administration of Justice, the Constitution, public order and the international community. 9. Ability to solve practical cases related to previous theoretical knowledge. 10- As a result of the above knowledge, critical capacity regarding criminal repression and effectiveness of it as a way of organizing living together in a social and democratic rule of law.
Learning Outcomes
K2: To know the principles and values of democracy and sustainable development, in particular, respect for human rights and fundamental rights, gender equality and non-discrimination, the principles of universal accessibility and climate change. K3: Master the fundamental concepts and principles of the different sectors of the legal system. K4: To know the importance of fundamental rights and public freedoms, as well as their scope and content. K6: To know the legal tools and instruments applicable to the interpretation and integration of the legal system, as well as to the resolution of conflicts, in the field of Public Law. K12: Understand the ethical dimension of law and the need to act responsibly in the defence of fundamental rights and social justice. S2: Use the information by interpreting relevant data avoiding plagiarism, and in accordance with the academic and professional conventions of the area of study, being able to evaluate the reliability and quality of such information. S4: Apply organizational skills and critical management of legal knowledge. S5: Correctly diagnose legal problems and apply the appropriate tools for their solution. S7: Apply knowledge to identify social processes and possible solutions with rigor, precision and scientific objectivity S10: Write and structure legal documents correctly. C1: Know how to analyse, elaborate and defend individually a problem in the disciplinary field of the Bachelor's Degree by applying the knowledge, skills, tools and strategies acquired or developed in it. C3: Select and interpret legal and conventional regulations, jurisprudence and judicial doctrine applicable to different legal systems. C4: Be able to solve complex legal problems by applying creativity and innovative ideas.
Description of contents: programme
The program covers the study of the criminal offences included in the Special Part of the Criminal Code related to individuals and society: homicide and its forms, abortion, bodily harm, offences against liberty, offences against moral integrity, human trafficking, offences against sexual freedom, failure to render assistance, offences against honour, offences related to land planning, offences against historical heritage, environmental crime, drug trafficking, forgery, offences against public administration, offences against the Constitution, offences against public order, terrorism, and international crimes. This course is fully aligned with the Sustainable Development Goals, specifically Goal 4 on Gender Equality and Goal 16 on Peace, Justice, and Strong Institutions.
Learning activities and methodology
The course will consist of both theoretical lectures and practical classes (focused on case-solving). To make the most of the sessions, it is advisable to read the relevant topic or topics in advance using one of the recommended core textbooks. Tutorials will be scheduled at the beginning of the course in Aula Global, although it is recommended to arrange them in advance with the teaching staff. In this course, students are not permitted to use artificial intelligence tools to complete assignments or exercises set by the lecturer. Should the use of AI by a student result in academic fraud by falsifying the outcomes of an exam or assignment required to demonstrate academic performance, the provisions of the Regulations of Universidad Carlos III de Madrid implementing, in part, Law 3/2022 of 24 February on university coexistence will apply.
