Objectives
GENERAL OBJECTIVES - Ability to present facts both orally and in writing, and to draw legal conclusions based on argumentation, taking into account the context and intended audience. - To know, identify, understand, and apply in practice the essential principles governing the digital society. - To develop the capacity to interpret the legal, organisational, and contractual framework that regulates and conditions professional activities in the field of public and private activities in the digital society, and to apply this knowledge in the various areas in which the professional activity may be exercised. - To acquire the ability to identify situations that may compromise the rights of individuals in public and private activities within the digital society. - To analyse, plan, evaluate, and control the risks arising from non-compliance with the specific regulations applicable to public and private activities in the digital society, and to propose appropriate solutions. - To identify conflicts of interest and understand the techniques for resolving them within the subject areas of the master¿s programme, while preserving professional secrecy and confidentiality in all cases. - To be able to gather evidence, master the techniques applicable to each type of evidence to ascertain the facts, and assess the available materials across the master¿s areas of study in order to initiate administrative or judicial proceedings. - To understand and be able to integrate the defence of service providers¿ rights in the subject areas of the master¿s programme before the competent public authorities and within judicial settings. - To develop the skills necessary to choose the appropriate strategy for defending the rights of individuals in the context of public and private activities in the digital society. - To acquire a critical approach to the analysis of legal texts, in order to interpret and, where appropriate, apply them accurately within the fields covered by the master¿s programme. SPECIFIC OBJECTIVES - Ability to identify and determine the legal implications of specific issues arising from public and private activities in the digital society. - Training to identify the applicable legal framework for addressing problems within the scope of public and private activities in the digital society, and capacity to organise and determine the applicable legal regime. - Skill in locating and identifying both judicial and administrative precedents that may be used to resolve specific cases within the domain of public and private activities in the digital society. - Familiarity with mechanisms to compile bibliographic and other relevant information on specific legal problems in the context of public and private activities in the digital society. - Competence in drafting legal reports and professional and official documents. - Rhetorical skills to present information and reasoning in support of solutions to specific legal problems related to public and private activities in the digital society.
Learning Outcomes
Description of contents: programme
The final project consists of the analysis of a specific topic, aimed at drafting a report to be completed individually or in groups, on a current issue previously assigned by the professor coordinating the module on Regulation of the Digital Society: ICTs in the Public and Private Sectors. At the beginning of the module, the topics will be assigned and a submission date will be set, which will coincide with the end of the module. On the scheduled submission date, students will also carry out an oral presentation of the project. Throughout the duration of the module, specific sessions will be held to provide guidance on the preparation of the projects. These sessions will be both collective (with all students) and individual (with specific students or groups). In both the preparation of the project and its oral presentation in class, all group members must participate and may be asked questions about any part of the content. The presentation must include a reasoned overview of the main findings of the project, especially the conclusions. The oral presentation and defence of the project constitute the core element of the assessment, as it allows the faculty to evaluate whether the student has adequately understood the subject matter, whether they can confidently address the issues identified, whether they are familiar with the relevant legislation and case law, and whether they are able to respond to questions raised. The time allotted for the presentation is limited, which also enables the assessment of the student¿s clarity, efficiency, and confidence in handling the material and delivering the presentation.
Learning activities and methodology
LEARNING ACTIVITY Students must produce an individual or group paper on a specific area of the regulation of the digital society, applying all knowledge acquired in the three subjects of the module. The work must be based on the applicable legislation and case law, as well as existing academic doctrine, and must include original and critical contributions. To this end, at the beginning of the module, the module coordinator will assign the specific topic to be addressed individually or in groups. The report must provide a legal analysis of a complex issue in the sector. The analysis should cover, at a minimum: what the issue consists of, its applicable legal framework, its legal implications and problematic aspects, and proposed solutions, recommendations or personal opinions. TEACHING METHODOLOGIES Students will be assigned a topic in advance, which they will develop individually or in groups under the supervision of the professor, through in-depth study and research. Students will be provided with a general bibliography and links to the university library to guide them in drafting the report. These resources will also serve as preparatory tools for their Master¿s Final Project (TFM). The final paper must focus on the assigned topic and be based on relevant national, regional or local regulations, national or European case law, and/or comparative legal and jurisprudential sources. On the submission date, students will present and discuss the report in class. This presentation, moderated by the professor, will follow a structured discussion based on a guide with questions and issues related to the topic presented. TUTORIALS Students will have access to tutorials with the professor responsible for coordinating the module on the regulation of the digital society: ICTs in the public and private sectors. They will also meet in dedicated sessions with the course coordinator to resolve doubts and refine the scope, bibliography, objectives and structure of their work. Tutorials aim to organise the teaching and learning process through interaction between the student and the professor, with the following objectives: (i) To guide the student¿s individual and group work. (ii) To explore in greater depth specific aspects of the subject matter. (iii) To support the student¿s academic and professional development.
