Objectives
GENERAL OBJECTIVES - To understand, identify, comprehend, and apply in practice the essential principles governing digital markets and services. - To develop the ability to interpret the legal and organizational framework applicable to digital markets and services. - To analyze, plan, assess, and manage the risks arising from non-compliance with digital markets and services regulations. - To interpret, analyze, and assess the regulatory framework governing the digital markets and services sector, and to provide legal advice on general matters. - To acquire critical analytical skills for the proper interpretation and, where appropriate, application of legal texts in the areas covered by the Master¿s programme. - To identify the public authorities and bodies operating in this field, their competences, actions, decisions, and rulings. SPECIFIC OBJECTIVES - To identify and understand the technological foundations on which digital markets and services operate. - To identify and understand the economic principles underlying the functioning of digital markets and services. - To acquire a solid foundation in intellectual property law, particularly in the digital environment. - To advise, negotiate, and defend the interests of individuals and entities in the contracting of IT goods and services, domain name acquisition, and the use of digital identity systems. - To distinguish between the various types of digital services and differentiate them from related sectors such as telecommunications and audiovisual services. - To be able to provide legal advice for launching business activities in digital markets and services.

1. Technological, Economic, and Legal Foundations of the Digital Environment. 1.1. Technological foundations of the digital environment: basic elements of ICT. 1.2. IT services: electronic signatures, electronic documents. 1.3. Internet technologies: secure protocols and secure communications. 1.4. Technological innovation and development as drivers of the Digital Single Market. 1.5. The challenges of new digital environments in the global economy. 1.6. Basic aspects of intellectual property. 1.7. General framework of intellectual property in the digital domain. 1.8. Exploitation of intellectual property rights in the digital domain. 1.9. Protection of intellectual property rights in the digital domain. 1.10. Case studies on intellectual property in the digital domain. 1.11. Industrial property: protection of technological innovations in the digital society. 1.12. Competition law in the digital society: data-driven and innovation-based competition. 2. Common Elements of Digital Activities 2.1. Domain names (I): international and national allocation. 2.2. Domain names (II): conflicts, cybersquatting, and in particular, trademark protection. 2.3. Contracting IT goods and services: features, elements, stages, and clauses of IT contracts. 2.4. Contracting IT goods and services (II): analysis of the main IT contracts (escrow, outsourcing, housing, hosting). 3. Digital Identity and Electronic Trust. 3.1. Electronic identification (I): legal framework of electronic signatures. 3.2. Electronic identification (II): elements, issuance, and functioning of electronic signatures. 3.3. Electronic trust services: levels of identification, valid identification systems, and legal effects. 3.4. Legal framework for biometrics: in particular, its use to ensure identity verification. 4. Legal Regime of Digital Services and Markets. 4.1. General framework of digital services. 4.2. Definition, scope, and subjects governed by the Spanish Information Society Services Act (LSSI). 4.3. Providers of intermediary services. 4.4. Liability of information society service providers. 4.5. The new regulatory framework for digital services: the Digital Services Act. 4.6. The new regulatory framework for major platforms: the Regulation on Business Users and the Digital Markets Act.
Learning activities and methodology
TRAINING ACTIVITIES - Theoretical-practical lectures. - Research and analysis of training materials such as case law, administrative decisions, etc., and the preparation and presentation of related assignments. - Individual student work: written assignments, oral presentations, defence of work, etc. - Resolution of practical cases. Active student participation in class sessions is essential. As this is an in-person Master¿s programme, class attendance is a key requirement for student assessment. Students must comply with the attendance requirements set out in the academic regulations of the Master¿s Programme and in AULA GLOBAL in order to be assessed. TEACHING METHODOLOGIES The teaching methodology used in this course includes: - In-class lectures by various professors using digital and audiovisual tools, focusing on the core concepts of the subject and providing bibliographic references to support student learning. - Critical reading of texts recommended by the lecturer: press articles, reports, legal rulings, manuals and/or academic articles, either for in-class discussion or to deepen and consolidate knowledge. - Resolution of practical cases and problems proposed by the lecturer, either individually or in groups. - In-class presentation and discussion, moderated by the lecturer, of issues related to the subject matter, such as case law, legislation, and administrative rulings. - Preparation of individual or group papers and reports, based on research conducted by students. TUTORING Students will have access to tutorials with the faculty member responsible for coordinating the course. Tutorials are designed to support the teaching and learning process through direct interaction between students and the lecturer, with the following aims: (i) To guide students in their autonomous and group work. (ii) To explore specific aspects of the subject in greater depth. (iii) To provide academic and holistic guidance for students¿ overall development. Tutorial sessions will be scheduled and conducted in accordance with the arrangements established by the lecturer via Aula Global.
